Yes, but they could have passed a new rule sooner rather than later. Actually, I don’t know whether they need to pass a new rule or not, or whether the rule actually just becomes null and void. I might be able to ask someone who knows.
Well their current rule is under court injunction and to start the whole rule making process from scratch and to complete an environmental review would most likely be longer than nine months anyway even if they were so inclined.
Ditto what ParatrooperJJ said – to make a new rule they’d have to comply with the court order on the previous rule or face a suit at the very least. Save the taxpayers’ money and wait 9 months.
(If the earlier rule-making process hadn’t come to grief, things might be different).
