New “Bipartisan” Bill Introduced To Ban Those on No-Fly List

Guilty until proven innocent is what this is, and if this were introduced as a bill to prevent people on these lists from publishing, attending mosque, or using social media, there would be outrage, and justifiably so. The people behind this affront to constitutional liberties:

  • Heidi Heitkamp (D-ND). So much for her holding firm.
  • Kelly Ayotte (R-NH)
  • Martin Heinrich (D-NM)
  • Jeff Flake (R-AZ) WTF? He must love himself some “law and order” and secret lists. This is the kind of stab in the back I’d expect from McCain!
  • Tim Kaine (D-VA)
  • Lindsey Graham (R-SC). Dude is an AR-15 shooter. For real. He also must love himself some secret lists and “law and order.”
  • Angus King (I-ME).

The no-fly list itself ought to be viewed as an unconstitutional infringement on the right to travel. This bill doesn’t have a number yet, but get ready to call your lawmakers and demand they vote no. There’s enough leftist groups uncomfortable with this crap that they have no excuse to vote yes.

Note now there’s an assumption that “if you can’t board a plane in this country, you shouldn’t be able to buy a gun,” as if it’s perfectly accepted that the government can keep secret lists of people that interfere with the right to travel. See how they did that?

Note Pat Toomey isn’t on this list. Must be an election year, or his bill is coming soon.

UPDATE: Toomey has announced he’s supporting this bill.

  1. Are Chris and Wayne supporting this affront to liberty the same as they did for the Cornyn bill?

    1. The Cornyn bill had a 72 hour time limit for the FBI to do something or else the sale went through. This has no time limit. It just lets the FBI make a list of people they don’t want to buy guns.

  2. From Politico
    “”
“To my friends at the NRA, I understand your concern about denying somebody the right to buy a gun, that’s a constitutional right,” said Sen. Lindsey Graham (R-S.C.), who also supports the Collins measure. “But every right, whether it’s speech or buying a weapon or any other constitutional right, has boundaries on it.”
    “”

So /yes/ sounds like he is amenable to using secret lists to block free speech too.

And interesting that the Dems are still unhappy with this “compromise”

    1. “shall not be infringed” doesn’t sound like boundaries to me Graham, you puke.

      1. Even if one accepts the boundaries premise, just because there may be a boundary doesn’t mean it needs to be that restrictive.

    1. She is definitely up reelection this year. As of this year, I am no longer voting for the “better choice of a very poor lot.” And please stop listing Ayotte as (R-NH). More accurate would be (☠-NH).

I can’t think of a single issue where she has taken the constitutional position. She also wants to enshrine into law the concept of guilty until proven innocent for college men accused of rape, with no due process available.

A thoroughly ugly person from a moral perspective.

        1. We should not vote for them, and convince our 2A allies to vote for someone else too.

  3. Call your senators please; 202-224-3121
They all have contact forms on their web pages as well.

No gun control. No secret lists. No Collins-Ayotte amendment.

Accourding to GOA; ‘There is no statutory limit to the number of people who could be placed on lists based on “credible” secret evidence.‘

      1. I meant, specifically, on this proposal. I read his web page stuff on 2A. I also read of his past support for gun control. Both are just words without context. This is context.

  4. The 14th Amendment was not intended to protect an alien’s right to keep and bear arms. Almost everyone on the various watch lists are foreigners. Amend the 14th to deprive 2nd Amendment liberties from non-citizens. Problem solved.

    1. No, it would not work in the past several attacks. The attackers were born in the US.

Ft Hood Hassan was born in Arlington VA.
San Bernadino Farook was born in Chicago
Orlando Omar was born in NY

The Tsarnevs didn’t use guns, they used bombs.

    2. People in the United States on non-immigrant visas can’t purchase firearms as it is. They are already prohibited persons regardless if whether they are on any list. If you have a green card, however, you can. As it should be, because those people enjoy the same basic human and constitutional rights as we do.

  5. “In cases where the classified information is relied upon, the court would have a range of options to protect the information while fully ensuring due process. These options range from providing an unclassified summary to disclosing some or all of the classified information.”

A summary prepared by the government is no substitute for full discovery. Secret evidence unavailable to a defendant should not be admissible in any court, ever. That’s the price of being a constitutional republic rather than an Orwellian nightmare.

  6. What is the limit for the lists?

I could see a lawless government put huge numbers of people on the Selectee list, based on the flimsiest justifications. Born or live in Idaho? Lots of White Supremacists in Idaho. Who cares if you are African American and live in Boise?

You know Texas is full of Insurrectionists, OK, AZ, NM, CO, and UT too.

Ever visit a blog like this one, WRSA, or Sipsey Street Irregulars? ON THE LIST!!!

Selectee list. You can still fly, you just get extra screening. Now you cannot buy a gun either. Can you get a Carry permit? Can you keep your carry permit? You are on THAT LIST!

I was either unlucky and got extra SSSS screening six times in a row, or I was on the Selectee list for a few years.

Yeah, they have to decide in fourteen days. What is the penalty if they blow you off? Nothing. Nada. Bupkis. They promise to be timely. If 150 million are on the list, they will use that as the excuse too. Timely? Tell that to the people waiting on FOIA requests they filed in 2009.

Bad law. It will solve nothing. Even the FBI doesn’t want it.
